Welcome to Gimme Green Earth, LLC ("Company," "we," "our," "us"). By accessing or using our website at gimmegreenearth.com and any related services, listings, or communications provided by the Company, you agree to be legally bound by these Terms & Conditions ("Terms").

Please read them carefully before browsing listings, submitting inquiries, or making any purchase. If you do not agree with any part of these Terms, please do not access or use our website or services.

2. Eligibility

  • You must be at least 18 years of age to purchase property or enter into any agreement through our platform.
  • By using our services, you confirm that you have the full legal capacity to enter into binding contracts under applicable law.
  • If you are acting on behalf of a business entity, trust, or organization, you represent that you have authority to bind that entity to these Terms.

3. Property Listings & Information Accuracy

  • All land parcels listed on our website are subject to availability and may be withdrawn, modified, or marked as sold at any time without prior notice.
  • Property information, including parcel size, location, zoning, access, GPS coordinates, and APN numbers, is sourced from publicly available county assessor records and provided for informational purposes only.
  • While we make reasonable efforts to ensure accuracy, Gimme Green Earth, LLC does not warrant or guarantee the completeness, accuracy, or currency of any property information displayed.
  • Buyers are solely responsible for conducting independent due diligence before completing any purchase, including verification of boundaries, zoning, road access, utilities, flood zone status, environmental conditions, and title history.
  • We strongly recommend consulting with a licensed real estate attorney, land surveyor, or title professional prior to purchase.

4. Pricing & Payments

  • All prices displayed on our website are subject to change without prior notice.
  • Payments must be made through approved channels, which may include GeekPay, wire transfer, ACH, or other methods outlined in your purchase agreement.
  • Cash sales are considered final upon receipt of full payment and execution of a deed.
  • If owner financing is offered, buyers must adhere strictly to the payment schedule outlined in the signed Land Contract or Installment Agreement.
  • Late payments may be subject to late fees as specified in the contract, and continued non-payment after written notice may result in cancellation and forfeiture of prior payments unless otherwise specified.
  • Documentation, booking, or escrow fees paid to lock or reserve a parcel are non-refundable unless the Company is unable to complete title transfer due to Company fault.

5. Owner Financing Terms

Where owner financing is offered by Gimme Green Earth, LLC as the direct lender:

  • A Land Contract or Installment Sale Agreement will outline purchase price, down payment, monthly payment, interest rate if any, payment duration, and default terms.
  • The deed of conveyance will be recorded with the applicable county upon receipt of full and final payment unless otherwise stated in the contract.
  • Buyers under an installment plan may prepay their balance at any time without penalty unless the contract expressly states otherwise.
  • Buyers may access and use the property during the active payment term in accordance with local laws and contract conditions.
  • Any default or breach will follow the process outlined in the signed contract, which may include cure periods, written notice, cancellation, and forfeiture as allowed by applicable law.

6. Due Diligence & Buyer Responsibility

Gimme Green Earth, LLC sells properties as-is with no representations regarding future development potential, investment return, resale value, or livability.

Buyers are responsible for independently verifying parcel boundaries, legal description, zoning, permitted uses, road access, ingress and egress, utility availability, flood zone designation, HOA or POA requirements, back taxes, liens, and environmental conditions before purchase.

GPS center coordinates and county GIS data are provided to assist review, but they do not substitute for a professional survey.

7. Communication Consent

  • By providing your phone number or email address, you consent to receive communications from Gimme Green Earth, LLC by phone, email, and text message in connection with your inquiry or transaction.
  • You may opt out of marketing communications by replying STOP to text messages, clicking unsubscribe in marketing emails, or contacting us directly.
  • Transactional communications related to an active purchase, contract, payment confirmation, or title transfer are required to complete your transaction and cannot be fully opted out of while a purchase is in progress.
  • Standard message and data rates may apply for SMS communications.

8. Refunds & Cancellations

  • All sales are final unless otherwise stated in a written agreement signed by both parties.
  • A refund will only be issued if the Company is unable to deliver clear and marketable title, a material Company error caused purchase of a materially different parcel, or the signed agreement expressly provides for a refund.
  • Down payments and documentation or booking fees used to reserve a parcel under a financing agreement are non-refundable once the contract has been executed unless the Company fails to perform.
  • Buyers who wish to cancel an active installment contract should refer to the cancellation terms in their signed agreement.

9. No Guarantees or Warranties

  • Gimme Green Earth, LLC makes no representations or warranties regarding future value, investment performance, development potential, or suitability for any specific use.
  • Zoning designations, utility access points, and land use restrictions are determined by local authorities. We are not responsible for changes after sale.
  • Property descriptions, photos, and maps are for general reference only and do not constitute a survey, legal description, or appraisal.
  • The Company does not guarantee that a property is free of environmental hazards, encroachments, or easements unless expressly stated in the purchase agreement and confirmed by title search.

10. Intellectual Property

All content on this website, including text, photographs, maps, logos, graphics, and listing descriptions, is the property of Gimme Green Earth, LLC or its licensed content providers and is protected by copyright and intellectual property laws.

You may not reproduce, distribute, modify, publish, or use website content for commercial purposes without our express written permission. You may share listing information for personal, non-commercial reference only.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Gimme Green Earth, LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website, services, or any property purchased through us.

In all cases, our total liability to any buyer shall not exceed the total amount paid to the Company for the specific transaction giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Gimme Green Earth, LLC, its officers, members, employees, agents, and representatives from claims, damages, losses, costs, and expenses arising out of your use of our website or services, breach of these Terms, misrepresentation, or failure to conduct proper due diligence.

13. Third-Party Links & Services

Our website and social media channels may contain links to third-party websites, tools, or services, including payment processors and mapping platforms. These are provided for convenience only.

Gimme Green Earth, LLC has no control over third-party content, privacy practices, or availability and is not responsible for harm arising from use of those services.

14. Privacy

Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Dispute Resolution

  • The parties agree to first attempt resolution through good-faith negotiation by contacting us directly.
  • If direct negotiation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with rules of a mutually agreed arbitration provider, unless either party elects to bring the matter in a court of competent jurisdiction.
  • You agree that any dispute will be resolved on an individual basis and waive the right to participate in any class action proceeding.

16. Governing Law & Jurisdiction

These Terms and disputes arising from them shall be governed by the laws of the State of Pennsylvania, USA, without regard to conflict of law principles. Legal proceedings not resolved through arbitration shall be brought exclusively in courts of competent jurisdiction within Pennsylvania.

While our governing law is Pennsylvania, Gimme Green Earth, LLC operates in Texas, Arizona, and Florida. Buyers should be aware that state-specific land sale regulations, county regulations, and local property rules may apply to their transaction.

17. Severability

If any provision of these Terms is found unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. Remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with any executed Purchase Agreement, Land Contract, or other signed documentation between the Company and buyer, constitute the entire agreement between the parties and supersede prior understandings, representations, or agreements.

19. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes become effective upon posting with an updated Last Updated date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
